PATEY MEDIATIONS RATES AND CANCELLATION POLICY
(Effective June 1, 2026)
TIER 1: STANDARD PERSONAL INJURY / INSURANCE MEDIATION (ROSTER-ALIGNED1)
- Half-Day (3 Hours): $600.00 + HST
Applies to two-party matters, including motor vehicle claims involving both driver and owner defendants represented by the same counsel, or slips/trips and falls involving both occupier and property manager defendants represented by the same counsel - Full Day (up to 6 Hours): $1,200.00 + HST
Equivalent to two roster-rate half-days. Includes prep and any post-mediation follow-up. - Multi-Party Mediation (3+ independently represented parties2): $1,200 + HST (3 hours) or $2,400 + HST (full day)
- Additional Time (beyond booked hours): $250/hour + HST3
- No Charge for Rescheduling4
- Pro Forma Mediation Service (Compliance-Only Attendance)5
Where counsel advise in advance that the mediation is being scheduled solely to satisfy the mandatory mediation requirement under the Insurance Act or Rule 24.1 of the Rules of Civil Procedure, and there is no reasonable prospect of resolution, the following policy applies: Flat Fee (up to 1.5 hour total) $500 + HST. Pro Forma mediations are typically scheduled at 8:30am on weekdays for up to 1 hour. Please contact Dan at 416-779-2915 to arrange.
Cancellation Policy:
- More than 10 business days’ notice: No cancellation fee
- Between 5 and 10 business days’ notice: 50% of the applicable mediation fee
- Less than 5 business days’ notice: 100% of the applicable mediation fee.6
TIER 2: ESTATE, EMPLOYMENT AND CIVIL LITIGATION NON-PI FILES (STANDARD RATE)7
- Half-Day (3 Hours): $1,200 + HST
- Full Day (up to 6 Hours): $2,400 + HST
- Additional Time (beyond booked hours): $375/hour + HST (See Footnote 2)
- Administrative Support Included (via Dan van der Burg, ODR Coordinator)
- No Charge for Rescheduling
Cancellation Policy:
- More than 10 business days’ notice: No cancellation fee
- Between 5 and 10 business days’ notice: 50% of the applicable mediation fee
- Less than 5 business days’ notice: 100% of the applicable mediation fee
OPTIONAL ADD-ONS:
- Pre-Mediation Caucus for 1 hour: $175 Flat Fee + HST
- Mediation Summary of Offers (Password Protected Excel Chart): $300

1. “Roster-aligned” refers to mediations governed by Rule 24.1 of the Ontario Rules of Civil Procedure in Toronto, Ottawa, or Windsor, where the Ministry of the Attorney General sets capped rates for mandatory mediations.
2. To a maximum of 7, thereafter an additional $75/party.
3. Additional Time (Overtime Surcharge): $250/hour + HST (Tier 1) / $375/hour + HST (Tier 2) applies automatically once the scheduled mediation time has been exceeded. Overtime is billed in full-hour increments once the additional hour begins.
4. As long as an alternative mutually agreed-upon date is provided at time of rescheduling, otherwise our Cancellation Policy applies.
5. Includes: brief review of file, receipt of baseline opening positions from all parties, up to 1 hour of attendance, and submission of mediator’s report. Important: Even in pro forma matters, the mediator must receive sufficient summary positions or documentation from each party to independently assess whether any productive engagement is possible before concluding the matter as non-settleable. For additional time beyond 1 hours overtime policy applies. This rate applies only where the pro forma nature of the mediation is confirmed by all counsel in advance and supported by their limited opening positions.
